New York Sued Kalshi for $36 Billion. The CFTC Filed Back. Here’s What the Legal Fight Means.

On July 31, New York Attorney General Letitia James filed a lawsuit against Kalshi in state Supreme Court in Manhattan, seeking a minimum of $36 billion and asking a judge to halt the company's operations in the state. Governor Kathy Hochul announced the filing alongside James. Hours later, the Commodity Futures Trading Commission filed its own federal action seeking to block New York from enforcing the case.

The same contract. Two governments. Opposite legal theories. This is where the prediction market industry stands today.

What New York Is Alleging

New York's lawsuit contains eight causes of action. The core allegation is that Kalshi has operated an unlicensed sports event contract platform in New York without obtaining a licence from the New York State Gaming Commission — and that, under state law, its contracts constitute gaming rather than financial derivatives.

The relief the state is seeking: forfeiture of all gains from New York users, full restitution to those users, fines equal to three times the company's total gains, and $100,000 for each individual offering attempt. The $36 billion figure is a floor, not a fixed sum — the actual total would depend on a full accounting of Kalshi's New York activity.

The lawsuit also highlights that Kalshi's platform allows users as young as 18 to participate. New York's gaming age is 21.

This is not New York's first move against the industry. The state previously sued Coinbase and Gemini over nearly identical allegations regarding their prediction market platforms. Kalshi itself had pre-empted the state — it originally sued New York in October 2025 after the Gaming Commission issued a cease-and-desist order. A federal judge in the Southern District of New York denied Kalshi's request for a preliminary injunction in that earlier case. The July 31 state lawsuit followed immediately afterward.

The Federal Counter-Move

The CFTC's position is unambiguous: Congress gave the agency exclusive authority over event contracts traded on federally registered exchanges. The same day James filed, the CFTC filed an emergency federal motion to block New York's case from proceeding, arguing the state has no jurisdiction over a product regulated at the federal level.

The result is a direct collision between state and federal regulatory authority. The core legal question — whether a sports event contract sold on a CFTC-licensed exchange is a financial derivative beyond a state's reach, or a regulated financial contract or a gaming product in different packaging — has not been resolved by any federal appeals court.

New York's federal appeals court rejected Kalshi's request to pause the state's earlier Gaming Commission ruling. Kalshi moved to transfer the attorney general's new case to federal court. The procedural outcome of that move will determine whether the case proceeds in state or federal court — and which body of law governs.

Kalshi continues to operate its markets in New York while contesting both cases.

The Broader State Picture

New York is the largest state to move against Kalshi but not the only one. Washington became the fourth state to block the platform, alongside Michigan, Nevada and Massachusetts. Massachusetts' Supreme Court is expected to rule on a case that could produce a temporary statewide ban. Arizona is pursuing criminal charges. Ohio announced a $5 million fine for operating sports contracts without a state licence.

Minnesota went the other direction. A federal judge there overturned a potential statewide ban, finding federal preemption arguments credible. The Sixth Circuit's pending decision on Ohio and Tennessee remains the nearest thing to an appellate answer on the core question.
